The Ban On Horse Processing Should No Longer Stand

In the year of 2007, congress, after relentless pressure from animal rights activists, enacted a ban on the United States horse slaughter industry. This left ranchers, farmers, and horses to face the consequences. While lobbyists meant to help the horses of America, they have negatively impacted these animals in many ways. The ban on horse processing should no longer stand because of what has become of the horse industry, and the life of American horses. It has led to more animal abuse than previously existed, negatively affected the horse industry and economy, and let the American equine population grow to nearly unmanageable heights. In these countries, there are no laws governing the humane killing of animals. In these countries, horses have very little chance of dying painlessly. According to a report to Congress by the United States Government Accountability Office (GAO) the number of horses exported from the United States and then slaughtered increased from 33,000 in 2006 prior to the ban, to 138,000 in 2010, three years after the ban. (GAO, 12) In addition to the heartless killing tactics they now face, horses intended for slaughter now face extended transportation distances, which can prove hazardous. The ban of horse slaughter in the United States did not help these animals. Further problems that have arisen in relation to horse abuse include abandonment and neglect. Owners seeking to rid themselves of these costly animals, generally due to financial situations, have an increased difficulty in finding a place for their horses to go. This leads to abandonment or neglect. Horse owners who no longer want their horses, or cannot afford them anymore, face fewer options in getting unwanted horses off of their hands. The purpose of this requirement was that social and environmental issues would be described in the OTR and this would provide a wider level of information to the shareholder. In addition, it was expected that the OTR would in a way compel companies to carry out external audit of these issues. Specifically it was intended that the OFR would provide better information to the investors on the likely performance of the companies during the financial year. The contents of the OFR should have an overview of the capital structure of the company and the financial characteristics of the company. In addition, the OFR was required to provide the main risks and uncertainties that faced the company. Further, the OFR was required to have descriptions of the brand strength, market strengths, company reputation and RD, that is the resources that the company enjoyed in the market. Most importantly, the OFR required the companies to disclose the objectives and strategies of the company (Financial Reporting Council 2007). The OFR also required the companies to disclose its relationships with suppliers, customer and employees. In other words the company was required to disclose its relationship with the stakeholders of the company. The company was also required to comment on the reputation of the company, especially in relation to the society and the environment. Moreover, the company was required to comment on the impact the reputation would have on the future performance of the company (Yeldar. R. 2007). In the UK the OFR disclosures have been left to an extent to the directors of the company. Their views on the different points are critical in making the disclosure useful to the company. Moreover, the government has focused on the OFR to fill the lacunae in reporting that traditional financial statements left in the annual reports (Morris. G, McKay. S Oates. A, 2006). If the board is so inclined, then the OFR can simply be relegated to a public relations activity of the company. The point is that if companies choose not to include corporate responsibility issues in their OFR then there may be a need for a mandatory inclusion of corporate responsibility indicators in the OFR. Even though OFR is driving the companies to disclose corporate responsibility issues, the final decision to disclose remains with the companies (Gee. P, 2006). The OFRs are required to honestly disclose the performance, development and the position of the company to help the investor make better decisions. In addition, the OFRs are required to provide the salient factors and the important trend that affect the present financial performance and the future status of the company. It is believed that not too many boards of directors will be eager to make an honest disclosure of these trends. To assess the current state of narrative reporting in the UK let us take a look at the review of narrative reporting published by the ASB on January 15, 2007. The report gives some areas of improvement that is the key performance indicators are missing in narrative reporting, the companies are not careful in their description of the principal risks and uncertainties and do not mention their approaches in mitigating these risks and uncertainties. What is most important is that forward looking information is not disclosed in the narrative reports. The review lauds the companies for reporting an increasing number of environmental, employee and social issues, the companies are giving good description of current developments and present performance and that the companies are providing more or less good descriptions of their current business, markets, strategic plans and objectives (Ploix. H, Charkham. J 2005). The auditors are currently required to comment on whether the OFR is consistent with their knowledge of the Annual Report and accounts. However, it is often seen that currently the companies in their OFR often give spin over substance. The companies over emphasize their favorable performance and avoid mentioning their areas of weaknesses. It is expected that now the companies will be required to product a broader annual report and specify their non financial performance and plans for future. For example, Shell is the biggest emitter of greenhouse gases in the UK and has a share of 23% of all emissions from FTSE 100 companies but this is not mentioned in the OFR of the company. There are no specific plans either to reduce emissions. Similarly, BP and Scottish Power are responsible for 17% of the emissions but this is not clearly mentioned in their annual reports. The lacuna in the law is that the auditor is required to compare the OFR statements with the financial reports and accounts and check if the statements in the OFR are in agreement with financial reports and accounts. This does not require the auditor to mention the omissions that have been made from the OFR nor does the audit of the narrative statement require the board of directors to make statements that disclose the weaknesses of the company. It is clear that in case of Shell, BP and Scottish Power if their emission levels of greenhouse gases are mentioned and the weaknesses in their future plans of reducing these emissions are clearly delineated in their annual reports, then several ethical investors may decide to stay away from these companies (Cowan. N, 2006, p 137). The recent history of the OFR is that the OFR was first introduced in 1993 by the ASB. At that time it was not mandatory. The Companies Act 1985(Operating and Financial Review and Directors’ Report etc.) Regulations 2005 required quoted companies to prepare a compulsory OFR and other companies to include in their Directors’ Reports a business review. Small companies were exempt from the requirements of this regulation. The Accounting Standards Board issued an accompanying Reporting Standard that those companies that complied with the Reporting Standard 1 would be presumed to have met the OFR Regulations. In November, 2005 the Chancellor announced that the government wanted to do away with the need for quoted companies to prepare an OFR. In January 2006 the Repeal Regulation of 2005 came into force that did away with the need for quoted companies to make an OFR. The Reporting Standard 1 was converted into a Reporting Statement. This remains just as a guiding statement for companies that decided to produce an OFR (Vilers. C, 2006). In the next month that is February 2006 the government requested suggestions and comments on improving the narrative reporting requirements. In May 2006 the government publicized amendments to the Business Review legislation. Finally, in November 2006, The Companies Act was given the final assent. and the Business Review requirements are now given legal sanction. Gordon Brown’s decision to abandon the mandatory nature of the OFR has been supported by two arguments. First, the government claims it wants to reduce bureaucracy. Second, government feels that the new requirements for business review meet the EU requirements for narrative reporting. This is the official line of the government.. However, there are other reasons that are being given as the reason for the abolition of the compulsory clause. It is claimed that the abolition of the mandatory requirement is offered as an incentive to business to remain in the UK and to attract new businesses to the UK. It is a part of the race to make UK attractive to business investors. Several environmental organizations like Friends of Earth and NGOs have decided to file a law suit against the government to force it to see reason. They see the withdrawal of the mandatory clause as signal to the business sector to continue with their environmentally baneful expansion plans. These organizations had been earlier clamoring for mandatory social and environmental reporting for businesses. From this perspective it seems that Gordon Brown’s decision is not a good one. There are other reasons given to support Gordon Brown’s decision. The claim is that more than 80% of the listed companies will voluntarily comply with the requirements of Reporting Statement and generate OFR statements. Those that do not will face investor reaction and comply with the Reporting Statement requirements. Those that persist in not producing an OFR voluntarily will be perceived as not transparent by the investing public. In addition, the proponents of the abolition of mandatory OFR aver that the size and the complexity of the annual reports daunting to most investors. In 2005 the average length of the annual reports was 71 pages. Adding to this only confuses the shareholders. Finally, the materiality get out clause has made the compulsory OFR ineffective. This has also allowed companies to get out of the need to report their weaknesses. However, we should not write off the OFR as dead. Every business knows that it should have an OFR to inform its shareholder. The need for qualitative, non-financial information has been created in the investors. If a company does not produce an OFR the investor may suspect it several faults. The end result will be that the shareholders will find it prudent to stay away from companies that do not produce a comprehensive OFR. There will be reputed persons who will stay away from the boards of companies that do not produce an OFR that meets the standard prescribed by the ASB. The OFR lives in the business review. The government is not compelling the companies to produce an OFR but the shareholders, investors and other stakeholders will compel the companies to produce and OFR. Environmental organizations and NGOs will take up the matter with companies that do not report on social and environmental issues. Companies that refuse to make OFRs may be shunned by ethical investors, high profile employees and environmentally conscious business partners. The awareness has been created, guidelines have been drafted and the importance of corporate responsibility has been emblazoned. The OFR has taken on a life of its own and even without compulsion it will feature in the annual reports of most UK companies. As the consciousness of investors increases, as the top employees become choosier and as corporations become more environmentally sensitive, OFR will continue to thrive. There is no need to revive the mandatory clause. Enough consciousness has been created to make the corporate sector aware and alive to its reporting responsibilities, the Business Review is adequate for this purpose. Those companies that do not behave in a responsible manner will suffer because they will not be able to sustain the interests of stakeholders that matter. To sum, there are a number of reasons given in support of the abolition of the mandatory clause and a number of reasons are being given for the reintroduction of mandatory requirements for OFR However, the importance of the OFA has been driven home to the companies, the investors and other stakeholders. Financial reporting alone does not give enough information to make a decision and he knows that an OFA is important. With a focus in international business, I seek to use my education to help forge links between countries through commerce. My drive is to connect the East and the West in a mutually beneficial partnership, to bring understanding along with advancement. Business is a field that encompasses many trials and requires a tenacious spirit unafraid of pitfalls. Sweat and the The Gilded Six-Bits; patience Essays -

Sweat and the The Gilded Six-Bits; patience Zora Neal Hurston was an amazingly talented writer, not just a good female, good black, or good for the time, writer. She was able to blend together the vernacular with an artistic and articulate prose to illustrate the lives of her characters. Hurston was a very important writer for African Americans, her use of phonological "black vernacular" or dialect wasn't a ground breaking or innovative idea, but it allowed her to cast a more realistic light on her characters. For they are real on the page, they each have their own sounding voice, and they each have character flaws. She is rather successful with Sweat and The Gilded Six-Bits in creating authentic feeling stories. If you were to analyze Zora Neal Hurston's short story Sweat you could see several different possible themes to focus on. The first theme I picked up on was an early form of feminism; she works, manages her finances, and built her own home. Obviously, she had been beautiful when he was younger, Walter Thomas said that she was a "pritty lil trick." Although she has been brutally victimized by her husband throughout their fifteen year relationship she's still able to pull an iron skillet on him in the beginning of the story, after he scared her with his whip and messed with her clothes. This single act of defiance changed her life with Sykes, "It cowed him and he did not strike her as he usually did." This could be a story of vengeance, I don't personally feel that this is what Zora meant for the story. Hurston foreshadows that Sykes will get what he deserves at the end when Delia mumbles to herself, "Oh well, whatever goes over the Devil's back, is got to come under his belly." Also, the act of scaring Delia with the whip could have foreshadowed his ultimate death by the bite of a rattlesnake. You could imagine that Delia purposely allowed for Sykes to die, but I like to think that she really was too scared to move. The story could be read where one could focus on the racial aspects of the story where Sykes hates the fact that Delia works for white people. She is the "good" person in the tale who labors for white people, and he is the "evil" man who hates whitey. I don't think this the direction Hurston had in mind for Sweat. He was just plain evil, race had little to do with the kind of man he was. The Gilded Six-Bits, is an entirely different story than Sweat. In Sweat there is a disequilibrium in the relationship from the beginning of the story with domestic violence, that eventually leads to Sykes cheating on Delia. In The Gilded Six-Bits, the main character Missy May, has a loving husband and a happy life, also, she cheats on her husband Joe. This story deals more with race, especially since Missy May had an affair with Slemmons, a white man. Slemmons wasn't just any white man, he was a rich white stranger from the north. Unlike in Sweat, where Sykes apparently had been beating on Delia enough to kill three women, Joe actually loves Missy May. The most telling scene of Joe's love for Missy May is when he comes home to find her chopping wood and he stops her, even though it could be Slemmons' child and not his. It is amazing that these two tales were written by the same person, the common theme I find between the two of them is that of patience. Patience truly is a virtue and in both of these stories, life gets better when one is patient. Sykes eventually dies a painful death, and Joe forgives Missy May

Weather and Technology Weather has been almost an unpredictable element that the world faces every day. Predicting weather has almost been impossible until technology came into the picture. There have been big technological breakthroughs with satellites and radars that help forecasters predict future weather conditions all around the world. Technologies has advanced throughout the years and are continuing to become more advanced today. Technology has helped scientist understand the most dangerous natural disasters in the world to help protect the public and allow society get to a safe location when the time is necessary. Radar, stands for Radio detection and ranging. Radar transmits microwaves in a focused beam. The microwave energy bounces off of its primary object and returns as data to be measured (Weather Questions 1). Radar then will send pulses of energy, rather than a continuous signal, which it will then measure how far away the object was when the microwaves reflected off of it. Combined with the radar's ability to scan up and down and in a circular motion which allows the radar to detect elements in all directions, modern radars can measure three dimensionally and up to one hundred miles from the radar(Weather Questions 2). The development and advancement in the radar has progressed the ability to learn more about weather and its developments. As radar continually develops and becomes more advanced, the more likely scientist will be able to understand and predict the future directions and outcomes a storm may have. Weather satellites have been our eyes in the sky for more than 40 years. Weather satellite images showing the advanced weather fronts are regular elements of the news station. Radars and Satellites have greatly helped scientists predict the pathways of storms and weather fronts. Due to the advancement of technology scientists have started to learn and understand the devilments and anatomies of the most feared natural disasters such as Hurricanes, Tornadoes, and Snowstorms. Scientist’s predictions and discoveries have helped the public get into a safer location. Weather technology advanced and is continuing to improve to help prevent casualties and economic loses. The Difference Between Procedural and Substantive Law

The Difference Between Procedural and Substantive Law Procedural law and substantive law are the two primary categories of law in the dual U.S. court system. These two types of law play different but essential roles in protecting the rights of individuals in the United States criminal justice system. Key Terms Procedural law is the set of rules by which courts in the United States decide the outcomes of all criminal, civil, and administrative cases.  Substantive law describes how people are expected to behave according to accepted social norms.  Procedural laws govern how court proceedings dealing with the enforcement of substantive laws are conducted.   Two Categories of Law Substantive law - literally the â€Å"substance† of the law - governs how people are expected to behave according to accepted social norms. The Ten Commandments, for example, is a set of substantive laws. Today, substantive law defines rights and responsibilities in all court proceedings. In criminal cases, substantive law governs how guilt or innocence is to be determined, and how crimes are charged and punished. Procedural laws govern how court proceedings that deal with the enforcement of substantive laws are conducted. Since the primary object of all court proceedings is to determine the truth according to the best available evidence, procedural laws of evidence govern the admissibility of evidence and the presentation and testimony of witnesses. For example, when judges sustain or overrule objections raised by lawyers, they do so according to procedural laws. Both procedural and substantive law may be altered over time by Supreme Court rulings and constitutional interpretations. Application of Criminal Procedural Law While each state has adopted its own set of procedural laws, usually called a â€Å"Code of Criminal Procedure,† the basic procedures followed in most jurisdictions include: All arrests must be based on probable cause;Prosecutors file charges that must clearly spell out what crimes the accused person allegedly committed;The accused person is arraigned before a judge and given the opportunity to enter a plea - a statement of guilt or innocence;The judge asks the accused whether they need a court-appointed attorney or will supply their own attorney;The judge will either grant or deny the accused bail or bond and set an amount to be paid;An official notice to appear in court is delivered to the accused;If the accused and prosecutors cannot reach a plea bargain agreement, trial dates are set;If the accused person is convicted at trial, the judge advises them of their rights to appeal;In the case of guilty verdicts, the trial moves to the sentencing phase. In most states, the same laws that define criminal offenses also set the maximum sentences that can be imposed, from fines to time in jail. However, the state and federal courts follow very different procedural laws for sentencing. Sentencing In State Courts The procedural laws of some states provide for a bifurcated or two-part trial system, in which sentencing is conducted in a separate trial held after a guilty verdict has been reached. The sentencing phase trial follows the same basic procedural laws as the guilt or innocence phase, with the same jury hearing evidence and determining sentences. The judge will advise the jury of the range of severity of sentences that may be imposed under state law. Sentencing In Federal Courts In the federal courts, judges themselves impose sentences based on a more narrow set of federal sentencing guidelines. In determining an appropriate sentence’ the judge, rather than a jury, will consider a report on the defendant’s criminal history prepared by a federal probation officer, as well as evidence presented during the trial. In the federal criminal courts, judges use a point system based on the defendant’s prior convictions, if any, in applying the federal sentencing guidelines. In addition, federal judges do not have the leeway to impose sentences more or less severe than those allowed under the federal sentencing guidelines. Sources of Procedural Laws Procedural law is established by each individual jurisdiction. Both the state and federal courts have created their own sets of procedures. In addition, county and municipal courts may have specific procedures that must that must be followed. These procedures typically include how cases are filed with the court, how parties involved are notified, and how official records of court proceedings are handled. In most jurisdictions, procedural laws are found in publications such as the â€Å"Rules of Civil Procedure,† and â€Å"Rules of Court.† The procedural laws of the federal courts can be found in the â€Å"Federal Rules of Civil Procedure.† Basic Elements of Substantive Criminal Law In comparison to procedural criminal law, substantive criminal law involves the â€Å"substance† of the charges filed against accused persons. Every charge is made up of elements, or the specific acts required to amount to the commission of a crime. Substantive law requires that prosecutors prove beyond all reasonable doubt that every element of crime took place as charged in order for the accused person to be convicted of that crime. For example, to secure a conviction for a charge of felony-level driving while intoxicated, prosecutors must prove the following substantive elements of the crime: The accused person was, in fact, the person operating the motor vehicle;The vehicle was being operated on a public roadway;The accused person was legally intoxicated while operating the vehicle; andThe accused person had prior convictions for driving while intoxicated. Other substantive state laws involved in the above example include: The maximum allowed percentage of alcohol in the accused person’s blood at the time of arrest; andThe number of prior convictions for driving while intoxicated. Because both procedural and substantive laws can vary by state and sometimes by county, persons charged with crimes should consult with a certified criminal law attorney practicing in their jurisdiction. Sources of Substantive Law In the United States, substantive law comes from the state legislatures and Common Law - law based on societal customs and enforced by the courts. Historically, Common Law made up set of statutes and case law that governed England and the American colonies prior to the American Revolution. During the 20th century, substantive laws changed and grew in number quickly as Congress and the state legislatures moved to unify and modernize many principles of Common Law. For example, since its enactment in 1952, the Uniform Commercial Code (UCC), governing commercial transactions has been fully or partially adopted by all U.S. states to replace the Common Law and differing state laws as the single authoritative source of substantive commercial law.

What Does a Rigorous High School Schedule Look Like?

We at frequently use the term â€Å"rigorous† to describe course loads and course schedules. That’s because rigorous studies in high school are something that admissions committees look for specifically during the application process. They want to know that applicants are capable of difficult, college-level work.    It’s not surprising then that we often hear from students asking, â€Å"How can I make sure my course load is challenging or rigorous enough?† If you’re wondering how to assess if your classes are up to snuff and how to choose a course load that’s challenging without being overwhelming, this post is for you. Rigorous is a vague term, but it can be more helpful to think of your course load as it compares to the course loads of other students at your high school. Admissions committees understand that not all high schools offer a full suite of challenging course options. While some have dozens of AP classes or an IB program to choose from, others have only college placement or honors tracks available. Luckily, you don’t need to worry too much about how many options are available at your high school, since this is out of your control. Instead, you need to focus on choosing the most challenging options available to you. You can think of a rigorous course load as the one that represents the most challenging track available at your high school. To learn more about how your classes will impact your college applications, check out our post Should I Take AP/IB/Honors Classes? . Being the most challenging track available, a rigorous course load can sometimes be a little overwhelming, especially at first. You should start by easing into a challenging course load. During ninth grade, select classes that are rigorous enough to challenge you, but not enough so as to overwhelm you. Think of 9th grade as a time to test the waters and see what you’re capable of. Remember, it is always easier and looks better to add another class or transfer to a more challenging section than it is to drop a class or move down to a less challenging one.    In addition, balance your course selections with reasonable extracurricular commitments. Focusing on two or three extracurriculars is ultimately enough, especially if you stick with them consistently and work your way up to leadership positions or increased responsibility. Dropping an extracurricular after 9th or 10th grade is no big deal if doing so means that you can keep your grades up and take on more challenging classes. Our Early Advising Program helps students in 9th and 10th grade discover their passions and build strong academic and extracurricular profiles to succeed in high school. Admissions committees generally want to see well-rounded students insofar as having completed four years of coursework in each core subject area. This includes English, history, math, science, and usually a foreign language. In fact, many colleges require that applicants have completed four years of coursework in each of these subject areas just to meet application prerequisites. In these core subject areas, you should strive to take the most challenging courses that you’re capable of doing well in, and your primary focus in studying and achieving should be in these core subject areas. Taking any additional classes is not necessary, but it does represent an opportunity.    Beyond the core subject areas, any elective classes that you take should reflect your interests. This is an opportunity to reinforce any potential career choices or college majors. Rather than worrying about taking especially challenging electives, think of them as a chance to explore and demonstrate your interests. Taking electives shows intellectual curiosity and might even allow you to discover a new interest. The balance between better grades and harder classes is always a delicate one. We hear from many students wanting to know if they should take a harder class and get a B, or an easier one and get an A. While there’s no universal answer that will impress every admissions committee, it’s important to know that admissions committees aren’t interested in easy A’s. In fact, a 4.0 GPA in regular college-placement classes may actually be a deterrent to some admissions committees who are looking for students who want to challenge themselves. In general, a good rule of thumb is that if you think you can achieve a B or higher in it, take the more difficult class. Admissions committees will appreciate that you have worked hard for that B, rather than pursuing a less rigorous track. Planning a rigorous track starts in 9th grade. To get off on the right foot, you should make a four-year plan. The simplest way to do this is by using backward design. Start with 12th grade—what classes do you need to be taking in 12th grade in order to get into the types of colleges you hope to attend? These classes are generally the highest level courses available at your school. They might be AP or IB classes if your school offers them, or they could simply be honors level classes if that’s all your school has available. Work backwards from 12th grade to ensure that your prerequisites are met each year. It is much easier to work backwards incrementally from your final 12th grade goal than it is to start with your ninth grade classes and try to imagine where they’ll take you. It’s a good idea to meet with a guidance counselor as you create your four-year plan. You’ll want to ensure that you’re meeting all graduation requirements and that it represents a course schedule that is rigorous as compared to others available at your school. Your guidance counselor will be able to lend some insight into which paths are commonly taken by students with the same goals as you. In addition, remember that the classes you enroll in aren’t the only way to impress admissions committees. The ozone layer, the ocean, these are all not bound by territory, thus demands cooperation in terms of its protection. However, there are environmental issues that strictly demand the action of local governments. It is a universally accepted rule that resources found to one country belong to that same country. And if such country will create laws that will support logging without any clause on inter generational duty, then the international society cannot do much about it. This also goes with multi national corporations that pollute the air, but continuously operates because of the protection given by their host country. All environment issues are political issues because politics govern the relationship between the government and its people.
